Direct and indirect representation
What is Direct and indirect representation?
When a forwarder clears goods for you, it acts as a direct or indirect representative. The choice decides who is liable for the duty.
Also called: customs representative, customs power of attorney
In direct representation the forwarder acts in your name and on your behalf – you remain responsible to the customs authorities.
In indirect representation the forwarder acts in its own name but on your behalf. The forwarder is then jointly liable with you for duties and taxes.
Representation is agreed in a power of attorney, which should be in place before the first shipment.
